>> melissa: thank you katie pavlich, marie harf, and steve hilton. there you go, harris is out, melissa is in for her today. >> melissa: fox news alert for you now, the white house press briefing with kayleigh mcenany is set to begin any moment as president trump threatens to cut funding for some democratic led cities that he says are allowing anarchy, violence, and destruction. this is "outnumbered overtime," i'm meliss melissa francis. white house budget office yesterday, the president ordered a review of federal funds that go to cities like portland and seattle where recent protests have turned violent or even deadly. the memo reads in part "my administration will not allow federal tax dollars to fund cities that allow themselves to deteriorate into lawless zones."

the president also included new york on that list, governor andrew cuomo with this today. >> the president has been tweeting up a storm, as is his way. i believe the president is fundamentally a bully you can't bully new yorkers! we just don't get bullied. we don't respond well to it. the president says a lot of things, but fact still matter. even in this political environment. >> melissa: fox coverage on all of this, peter doocy is in kenosha, wisconsin, where joe biden plans to meet with the family of jacob blake two days after the president's visit there. but first, let's go live to white house correspondent john roberts. john. >> good afternoon, it's unclear exactly which authority the

president will be able to do but the president threatening to withhold federal funds from certain cities, targeting seattle, new york city, washington, d.c., and portland. directing federal agencies to look at what funds might be withheld if the cities don't do more to combat the lawlessness. "the trump administration will hold lawless jurisdictions accountable by reviewing federal funds provided to them, restricting their eligibility for certain federal grants where permissible, and working to direct those funds to jurisdictions that protect communities." basically taking from one city and giving to another. the threat to pull federal funding renewing his feud with the norco enter enter, in a press briefing, saying the president is not welcome in new york city. listen. >> he can't come back to new york. he can't, he's going to walk on the street in new york. forget bodyguards, he better have an army. if he thinks he's going to walk on the street in new york.

he is persona non grata in new york city. and i think he knows that. >> president responding to call him on twitter morning saying ope"has the worst record on debt and china virus, 11,000 people alone died in a nursing home's because of." >> is not often you hear a governor described in vivid detail how he lost control of his state, but there you have over in her cuomo saying you can't come to new york without an army. it's very rare you hear a democrat governor admit to failure and that's what he has just done for us. >> this is expected to come out in the press briefing by what authority the president leaves he can withhold funds. there will be a little fire at the top of today's briefing, kayleigh mcenany expected to take square aim at nancy pelosi over what happened at that san francisco salon.

order of business is a private meeting with jacob blake's family. the press pool that was traveling with biden from delaware shouted out questions to them on the tarmac asking what his message for the blake family was, but biden did not answer so will have to wait for that. biden also said he plans to meet in kenosha with business leaders and law enforcement officers. also expanding why he thinks now is a good time to come even though the mayor of kenosha said he didn't think it was appropriate yet for president trump or joe biden to come. >> my purpose in going will be to do just that, be a positive influence on what's going on. talk about what may be done and try to see if there's a beginning of a mechanism to bring folks together. we have to heal, this is about making sure that we move

forward. >> biden is trying to establish his position as a pro protesting, but anti-looting and rioting, he's arguing he is a uniter who thinks trump is a divider. the democratic nominee is on his way to the city where many structures and windows remain boarded up and buildings have been burned down, following jacob blake being shot in the back by the local police department. he remains in a local hospital seeking treatment. the campaign is careful about scheduling socially distance events and booking sanitized planes, one of those sanitized planes did just land, so we are awaiting biden here in kenosha, we expect that within an next two hours or so. >> melissa: peter doocy thank you so much for that. trump 2020 campaign director of communications aaron carini joins me now. joe biden on the ground now, we are hearing he will meet with

the family of jacob blake, the president did not do that. do you think it's appropriate to meet with the family? do you think the president should have? >> the president did reach out to try and establish a conversation with the blake family, but it's clear joe biden is just going to kenosha, wisconsin, for purely political reasons and that's really disappointing. he shouldn't be trying to politicize what happened in kenosha, president trump went in his official capacity. he has now stood up resources for kenosha including funding for the local police. over $40 million for the statewide safety, so you look at the difference here, president trump went and it official capacity to provide resources and to be a healer, joe biden is going for more political division and that's really disappointing as a city like kenosha tries to come back. >> melissa: he went with cameras during a season when he's running again for president.

that's not political? >> there's always a pool with the president of the united states, cameras follow him everywhere he goes. that's part of the coverage of the press and their right to do so. here's the thing, the president went and stood up resources, had a conversation, brought attorney general bill barr, and chad wolf to have a conversati conversation. joe biden is going not in an official capacity at all, but only as a political candidate. >> melissa: all the news this morning of course is about the idea that the president wants to withhold funds from the cities that he says are falling into anarchy. you heard governor cuomo's very strong words in response, and also saying the president is persona non grata in new york. does the president have the grounds to withhold that money? >> the president is asking for funding to be looked into, that's good governance. let's make sure that funds are being used appropriately, and for governor cuomo to make such a thinly veiled threat at the president of the united states,

that's disgusting. cuomo should be about that but apparently he's not. it's really disappointing to see that a governor again is choosing politics over facts here. he wants to try and divide his estate against the president. the present is welcome in any of the 50 states and he should be able to go anywhere without worrying a governor is going to make threats against him, that's disgusting. >> melissa: when you look at the people getting crushed in the undertow of this back-and-forth fighting, you have small business owners in all of the cities. whether it's people in new york who have had their business the victim of covid-19 and then rioting and looting or even female hair salon owner that we heard this morning in minneapolis saying that her store was broken into, set on fire, the police didn't come. what can the president do for them specifically? a lot of them say they feel

forgotten. >> president trump has been fighting every single day for every american, including the small business owners. it's so difficult to see people try to come back only to see violent riots and looting. the president has offered federal resources to be able and restore law and order to protect businesses and livelihoods. if we follow joe biden example you might still be looking at burning in wisconsin because he doesn't want to use the national guard, the president uses it when asked, he's been pursuing legislative opportunities to be able to provide funding for these individuals. you saw him provide $4 million to the people of kenosha, though small businesses as they begin to rebuild. there is no bigger champion for the american people and small businesses and then it president trump. >> melissa: you've said that we haven't heard joe biden condemned the writers, just yesterday he said this. >> i would make sure everybody understood that any violence,

any violence, protesting is a right and free speech is a right. but to engage in violence, burning, looting, unrest in the name of protesting is wrong. >> melissa: that's pretty clear, yeah? >> i mean it's good that after so long, after over 90 days of violence and riots in portland that joe biden came out to make those remarks went back in may, you saw president trump stand up and very unequivocally say healing not hatred. just is not chaos. president trump has always been firm that yes protect your rights to peaceably assemble but that you should be safe in your community, and this country. joe biden has made clear he's not interested in that. >> melissa: aaron carini from the campaign, thank you so much. we'll go to kayleigh mcenany at the white house now. let's listen.

>> we found nancy pelosi going into her hair salon, we will be playing the video on loop for all of you to see. nancy pelosi was not in the halls of congress when i asked where she was, she was not working in good faith to make a deal for the american people. nope, nancy pelosi was founded in san francisco at a hair salon where she was indoors, even though salons in california are not only open for outdoor service. apparently the rules do not supply the backup life. she wants small businesses to stay shut down but only reopen for her convenience. do as i say, not as i do, that's nancy pelosi. nancy pelosi is holding up $1.3 trillion in relief for the american people, while getting special access to the very kind of small businesses that the money would support, businesses like this hair salon. before she skipped town to

violate her state health guidelines, policy proposed a bill, called the heroes act which contained no additional paycheck protection funding. this is funding that would help the very small business she has bizarrely accused of plotting against her. the president sees through the disregard for americans in need and he took action unilaterally, he provided relief from evicti eviction, he provided unemployment insurance, he paused student loan payments and take out the payroll tax putting money in the american people's pockets. congress also failed to authorize funding to provide children with free lunches for the 2020-2021 school year and again president trump with senior advisor ivanka trump took action and usda has extended the summer program which will ensure children continue to have access to free meals through the end of the year. nancy pelosi is demanding an apology from a single mother and small business owner who has

received threats since nancy pelosi comments against her salon. a salon owner erica said this. since this happened, i received nothing but hate text messages, death threats, saying they are going to burn down my hair salon. it's sad that my community is a saying i threw her under the bus when i did not, that's hurtful. but yes, i think i'm pretty much done now. nancy pelosi, you ought to apologize to the american people or better yet, come back to washington and get to work for hardworking americans like this salon owner that you maligned and demanded an apology from. with that, alta questions. >> do you acknowledge that it's illegal to vote twice in the same election customer >> are you referring to the president's comments earlier today? the president does not condone unlawful voting, he's been very clear about this.

not surprised the media is taking the president out of context. >> i have it right here. >> read it out for me then. >> you should vote early, by mail and you should go either early voting or day off and try to vote again. he is asking people to vote by mail, and then to go down to the polling place on election day and vote again. if they can't confirm the vote has been counted. >> you are missing a very crucial line, if it is not tabulated meeting your mail in vote, then you will be able to vote in person. if it is not tabulated. >> there are five states in this country that they do not count any mail-in votes until election day. so those votes won't be counted until afterwards. so there's no way to know whether or not. >> there's a very simple answer,

a lot of states have what are called electronic bowl votes, what this means is that in real time it's updated. if your vote is counted, checked the electronic whole book and you won't be able to vote in person because it has been counted. there's a secondary situation, those who do not have electronic books you can cast a provisional ballot and that is a ballot that is there, if your vote hasn't been counted they will count the provisional ballot. what democrats are doing is saying this, we want an entire new system for voting, one subject to fraud, take it from jimmy carter. as part of a bipartisan commission, absentee ballots remain the largest source of potential voter fraud. trust us, but don't verify. don't verify that your vote has been counted, this president is trying to enfranchise americans which is exactly what he's been saying. he wants every american to have a vote, he understands what jimmy carter understood and what

so many of us understood, the president started putting the focus on mail-in voting and that was this. it's subject to fraud, every vote should count and every american should verify. >> the north carolina board of electors has said this would create a big problem. >> the president has laid it out very clearly, you should verify your vote and not only that i would appoint them to the fact that in 2016 before we tried this entire new system of mass mail out voting 319,000 votes were not counted, 319,000 and election that came down to 80,000 votes in wisconsin and michigan. if that's untenable and hundreds of thousands more will not be counted with the democrats fraudulent mail out voting system. >> the president signed a memorandum last night directing federal agencies to look at funds that might be withheld to cities that do not do enough to

restore law and order. by what authority does the president believe he can do that? >> the president believes that what we should do, the purpose of government is to protect life, liberty, and property, that is the purpose of the federal government and its imperative that the federal government review the use of funds by jurisdiction. what this does, this memo really does three things. it asks federal agencies to detail all federal funds that are being provided to seattle, portland, new york city, and to d.c. secondly within 14 days, the attorney general will develop a list of anarchist jurisdictions, lawlessness zones that are permitting violence and destruction of property and within 30 days, the white house budget director will issue guidance to the heads of agencies on restricting eligibility or otherwise disfavoring the maximum extent possible by law in their receipt of federal grants.

you can withhold funding as long as it pertains to what you are trying to incentivize. we believe here when you look at new york, 177% increase in shootings, seattle there was a lawless zone where to died, and portland you've seen 140 officers injured, if the state will not act to secure the streets, the president will use every lawful mechanism available to try to supplement their failures and in some cases that meant federal officers in minneapolis and kenosha where we've been invited, this is yet another attempt to make sure no more children die on our streets. >> their congressionally appropriated funds, you would expect there to be immediate legal action taken for the state of new york. if you try to withhold any funds, she will immediately slap you with a lawsuit. >> she is free to do that, we believe what we will do will be lawful within the bounds of the

law and we encourage states to act and cities to act in the way that kenosha and minneapolis did. although they delayed a little bit, they finally stepped up and ask for federal support and they got it. too many americans are dying our streets, too many businesses being burned to the ground. that's not the american way by a long shot. >> the president as we know tried to withhold federal money from sanctuary cities, and he lost. why isn't this also doomed to fail? >> i'm not going to get ahead of exactly what the final product will look like, there's a 14 day timeline for the doj. we leave we are on the right track. >> and may the president said the u.s. will be designate desig antifa as a terrorist organization. >> they said they would be looking at antifa related charges. >> they did not designate antifa. >> they will be pursuing

approved before election day that it is safe and effective? can you address the assertions? >> no one is pressuring the fda to do anything, this is a bizarre theory by cnn and others. the fda, you have dr. hahn who said this, 100% the president has never pressured me to make a decision regarding any regulatory aspect of the fda's work. he said that just a few months ago, it is absolutely the case. secretary azar saying this morning about the vaccine whether it's october 15th or november 1st or november 15th, this is all about saving lives. dr. fauci say we in fact briefed the president today just a few weeks ago, i was there for that briefing. dr. fauci said there is no political pressure i have seen to move quickly. this president wants to break through regulatory barriers to get a vaccine as quickly as

possible, because lives are at stake. but he will not in any way sacrifice safety and making sure this is 100% airtight for the american people. the priority here is saving lives. there will be a safe and effective vaccine in the works, again i think the cnn spinning up this conspiracy theory always based upon the cdc -- yes, cnn was peddling a theory on this as well. basically you had career officials at the cdc made a decision about distributing vaccines, were preparing in advance to have a safe and effective vaccine distributed because unlike the obama administration during swine flu they had real problems in that regard. the obama administration promised 100 million doses by october, they reduced that number to 40 million for the swine flu by mid-october, when demand for a vaccine was at its highest. supply fell dramatically short,

11 million doses on hand. we are nowhere near where we thought we'd be by now, we are not near where a vaccine manufacturers predicted we would be. unlike the obama-biden administration, we make plans in advance which is why we have contracts for 100 million vaccine production in advance, it's why cdc career officials have worked with all 50 states to make sure we can distribute the vaccine. we do our homework in advance unlike obama-biden. >> vice president joe biden said on the poisoning, it leaves no doubt as to whether responsibility lies, the russian state. does the president agree with that assessment? has he made his voice known to

we've done, we were met with an unprecedented challenge, the noble coronavirus that came to our shores from china and we are very proud that our contracts have enabled us to have a very large stockpile. we've rapidly increased the amount of n95 on hand, on track to have ten times more than prepandemic levels by the fall. significantly he surged at the number of gallons on hand, 27 million. and a tremendous level of ventilators on hand at 109,000 and will have 50,000 war, the contracts we've made have enabled these numbers, not even getting into therapeutic like brendremdesivir. >> the strategy for the pandemic has been called dangerous by

some experts, i'm wondering if president trump's formed an opinion on the concept and if he thinks that is an achievable goal. >> the herd immunity theory was something made up in the minds of the media, that was never something that was ever considered here at the white house. what we've done is raced to get a safe and effective vaccine in record time, get it by the end of the year. abel far outpaced ebola which took 14 months, this will be the fastest vaccine ever for a novel pathogen. we talk about therapeutics, we've identified more than 270 clinical trials, 570 in planning stages, that's what we do here at the white house. the herd immunity theory was something made up in the mind of the media. >> he would come up with a list of candidates by september 1st,

they withdraw law enforcement protection from certain areas like we saw where police briefing was abandoned in the lawless zone in seattle, those are the types of changes in behavior we want to see from cities protecting the citizenry should be their paramount concern. >> the government runs out of funding by the end of the month, if the white house confident they can avoid another shutdown? >> i haven't talked to him about that, but we do believe we will be able to get funding to avoid shutdown. >> i have to talk with the chief, i haven't talked with him specifically about that. i has been discussed internally. >> can you give us more of a sense of the funding that would be under review? what would the white house believe this is the right time to be considering cutting funding in the middle of a pandemic?

>> to the first part of your question, it's undergoing a review, part of that step one of the memo is for federal agents to get details on funds provided, i can't give you a readout until the review is conducted. why now? because in new york city you've seen 177% increase in shootings in july, meanwhile you have feckless government of mayor de blasio and governor governor cuomo pulling $1 million from nypd and my were down in new york city by 62%. the looting, the bes business is damaged. lives are at stake, and the lives of innocent little babies who should be here today. they didn't get funding from police. >> the president and joe biden

are both in pennsylvania next friday to commemorate 9/11. have you spoken to them about appearing with former vice president, like he did with secretary clinton in new york? >> i have no details for that upcoming event. we are intending that as well. >> one more follow-up on cities, i know it's under review. has the president directed to make sure future coronavirus aid is exempt from this? >> i don't see in what universe that would be connected to the issue at hand. again, i don't want to get into the specific funding ahead of the review process. that is ongoing. >> facebook said earlier today that he would be removing the posts where the president was talking yesterday with a local reporter about voting, if it's not corrected and it doesn't indicate that the president

was -- what you have to say about facebook's move on this question mike >> facebook transmitted a post? >> they said they would remove the post on the profile who posted and do not say the assertions of the president are wrong. >> i haven't seen it, but the president is crystal clear that he only, if your vote isn't tabulated then you'll be able to vote in person. it's about verifying every vote is counted because we know voters are disenfranchised. in the 2020 presidential primary there were $100,000 rejected in california, mail-in ballots and new york one and five, think about that, one in five mail-in ballots were rejected, a total of $84,000 rejected in new york city alone.

young, black, and hispanic voters are more likely to have their mail-in ballots rejected. the president wants enfranchisement, not disenfranchisement, that's his goal. >> the president has said that he will be issuing another order in september, do you have any more information when he may be issuing that? >> no updates on a forthcoming immigration order. >> you mention role models city like kenosha, mayor de blasio for instance, if they were too this week take specific action and get "law & order" back under control, would this memo continue to go forward or would you continue to propagate the plans within the memo? >> we would have to see a radical change in behavior from the mayor who allowed a church to burn, from the mayor of portland to stood with

protesters, look, when the local government doesn't act we use every avenue available to us at the federal level. as it pertains to this memo is one example, another is operation legend which we are very proud of, we have some new numbers for you on that. since the operation has launched more than 2,000 arrests including 147 homicide have been made, within 544 firearms have been seized and more than 7 kilos of fentanyl, 12 kilos of cocaine, and 50 kilos of methamphetamine have been seized and individuals arrested 476 have been charged with federal offenses and there is a detailed readout from the doj of each offense and the great work our

do you think she clarified there on that mail-in voting? >> i believe she did, i think anything the president says at this point will be taken out of context. it typically does when he is saying things in a way we can all appreciate and understand. to speak on these issues of fraudulent votes, it's a pervasive narrative, voter fraud doesn't exist. i encourage everyone of our viewers to go to the heritage foundation voter database and they show there was 1,296 instances of voter fraud, 1,119 criminal convictions by way of those front of frauds aired this is something that does exist and it's something that can legitimately impact the electio. >> melissa: this was karl rove in an opinion piece saying the real problem with mail-in voting may not be the post office, real

potential for delay and confusion lies with state laws governing when ballots are due and when they can be verified. plunge america into prolonged controversy and undermine confidence in the outcome of the democratic system, both something adversaries in moscow, beijing, and tehran would cheer. jenna, let me ask you about th that. we saw that here in new york just in our primary. where there was ballots were mailed out to people, and the postage was prepaid so it didn't have to be postmarked at the post office. this was an oversight they didn't realize if you prepaid the we will have no idea whether these folks were postmarked on time, it took six weeks to try and sort through what happened and there were a lot of people still not convinced we know who won the primary. there wasn't a republican anywhere in sight. this caused mass confusion, aren't we worried about this?

>> i think it's important that we start questioning a number of different components of our electoral system, and yes, each state has different rules and relations around when they are less terrifying votes and when ballots actually have to be in. but i think we've been really hard into this idea and start normalizing it's unlikely the election will be called on november 3rd. i think americans are used to the media creating a blockbuster feeling vibe on the night of election, and with some big huge moment where we are crossing the finish line. i think all americans can agree that it's much more important we get these numbers right, it's important to start wrapping our heads around the fact that it's unlikely the election will be called november 3rd. >> melissa: schiano, it's not
